URGENT NOTICE: PAYMENT OF STAMP DUTY

The Stamp Office has again highlighted to us of instances of technical errors in cheques issued by some legal firms.

Members are reminded to ensure that all cheques issued/drawn in favour of the Stamp Office for payment of stamp duty are correct, accurate and properly signed by authorised signatories.

Please note that the Stamp Office has fixed 15th July 2006 for full compliance by legal firms.

A photocopy of the letter from the Stamp Office dated 30th June 2006 is attached for your reference.

Anti Money Laundering & Anti Terrorism Financing

Are you a conveyancer?

Are you involved in the transfers of real properties?

With money laundering activities hitting on our shores, Parliament in her wisdom had legislated the Anti Money Laundering Act, 2001 (AMLA) and the AMLA is now applicable to all Advocates & Solicitors.

The Bar Council has issued Circular No. 48/2005 dated 23rd June 2005 to assist Members. Please note that the said Circular contains three (3) enclosures for Members’ reference and information.

Therefore Members are to download a copy of the said Circular (and enclosures) from the Malaysian Bar’s website or if you are not tech savvy (i.e. you are not plugged in) then you can obtain a photocopy of the said Circular (and enclosures) from the Penang Bar Room subject to payment of charges.

Conveyancing Practice Rulings (1997 Edition)

As a follow through from the Dialogue on 23rd June 2005, the above document is now available to Members of the Bar at the Penang Bar Room.

We wish to highlight to Members that the 1997 Edition is not comprehensive or exhaustive and there are additional Rulings made since 1997 which are not included in the above document.

We also wish to highlight to Members that the Rulings are presently under review by the Bar Council and the new revised Rulings have not been approved by Bar Council for publication. Therefore the 1997 Edition as contained in the Blue Booklet is currently in force.

If Members wish to have copies of the above document, it is available at a nominal price of RM2-00 per copy.

To All Members of the Penang Bar,

E Adjudication of Transfer

The Valuation Department, Penang called for a Dialogue with Members of the Bar on 19th May 2005.

During the Dialogue, the Valuation Department highlighted that a high percentage of applications for valuation under the E Adjudication process had been rejected mainly because of incomplete documents attached to the PDS 15.

The Dialogue had resolved several issues to be implemented for the better delivery of the E Adjudication process.

The following is the summary of the matters / issued discussed and resolved:-

1. All the pages of the Sale and Purchase Agreement must be scanned and attached to the PDS 15.

2. In the case of the sub sale of apartments without title, the Principal Sale and Purchase Agreement must also be scanned and attached to the PDS 15.

3. All the pages of the Strata Title or Title (including plans) must be scanned and attached to the PDS 15.

4. Title Searches can be scanned and attached to the PDS 15 in lieu of the Strata Title or Title.

5. Please scan the whole Sale and Purchase Agreement into one file and the whole Title or Title Search into another file.

6. Please ensure that the scanned files are in A4 size as the Valuation Department will need to print out the relevant documents sent to them.

7. Please name the attached files accordingly – for example, “spa”, “title”, “geran”, “birthcert”, “suratnikah”. This will assist the Valuation Department in identifying and opening the relevant files for printing. Do not send a scanned Transfer.

8. Please use pdf format for the attached files.

9. Members can use the Ulasan Box in the PDS 15 (if you wish) to state the special facts of the case. Examples are relationship between the parties, the exemption orders applicable.

Members are requested to comply with the above to assist in expediting the valuation process of the transacted properties.
